A first-offense DUI is a misdemeanor, carrying up to 1 year in jail and fines up to $1,000. However, a second DUI within 10 years becomes a felony with 1 to 5 years in prison. Aggravated DUI (BAC of 0.15% or higher) carries enhanced penalties even on a first offense. You also have only 30 days to challenge your license revocation.
